Welcome to eKubur.my (the “Platform”). These Terms of Service (“Terms”) govern access to and use of the Platform, including its website, accounts, funeral and burial service functions, memorial-related functions, Donation Programmes, Marketplace Services, customer support, content and related services.
The Platform is owned by B TAG VENTURE Sendirian Berhad (“B TAG”, “eKubur”, “we”, “us” or “our”). The registered address, company registration number and service contact details must be inserted before publication.
By accessing or browsing the Platform, creating an Account, submitting information, requesting a service, creating or administering Memorial Content, purchasing a product, making a contribution, or otherwise using the Platform, you confirm that you have read, understood and agreed to these Terms and the eKubur.my Privacy Policy.
If you do not agree to these Terms, you must not use the Platform. Additional terms may apply to particular products, campaigns, services or third-party providers. If additional terms conflict with these Terms, the additional terms will apply to the relevant transaction to the extent of the conflict.
In these Terms, unless the context requires otherwise:
“Account” means a registered user account used to access Platform functions.
“Content” means text, data, graphics, photographs, audio, video, software, pricing, listings, information and other materials made available through the Platform.
“Donation Programme” means a donation, infaq, waqf, sponsorship, fundraising or charitable initiative presented or facilitated through the Platform.
“Marketplace Services” means products or services offered, listed, reserved, ordered or purchased through the Platform.
“Memorial Content” means information relating to a deceased individual, including names, dates, photographs, tributes, biographical details, funeral or burial information, prayers and messages.
“Service Provider” means a third party that supplies or fulfils a funeral, burial, transportation, religious, cemetery, product, payment or other service.
“User Content” means information, photographs, comments, reviews, documents, Memorial Content and other material submitted by a user.
“you” or “user” means a person accessing or using the Platform, including a person acting for a family, organisation, estate or other authorised party.
You may use the Platform only if you have legal capacity to enter into a binding agreement, provide accurate and complete information, comply with applicable law, and satisfy the applicable minimum-age requirement.
The minimum age for independent use is 18 years old. A person below that age may use the Platform only through a parent, guardian or other person lawfully authorised to act for that person, where permitted by law.
If you act for another person, family, organisation, estate, trustee, campaign or representative, you represent that you have authority to act and to provide the relevant information. We may request evidence of that authority.
Certain functions may require an Account. You must provide accurate, current and complete information and update it when necessary.
You are responsible for safeguarding credentials and for activity conducted through your Account, except to the extent responsibility cannot lawfully be imposed on you. You must promptly notify us of suspected unauthorised access or security compromise.
You must not transfer, sell, share or permit unauthorised use of an Account. We may request identity, authority or transaction verification and may restrict access pending verification.
The Platform may provide, arrange or facilitate funeral and burial arrangements, cemetery or burial-plot services, transport, memorial and remembrance functions, administrative assistance, documentation support, Donation Programmes, religious or educational resources, Marketplace Services, notifications and related support.
Availability may depend on location, eligibility, urgency, Service Provider capacity, cemetery requirements, religious or administrative requirements and circumstances beyond our reasonable control.
For a specific service, our role may be that of provider, coordinator, facilitator, intermediary or marketplace operator. The applicable listing, order confirmation or service documentation should identify the relevant role and any Service Provider.
The Platform may allow users to submit, create, maintain, update, display or administer Memorial Content and deceased-person records.
By submitting Memorial Content, you represent that the information is accurate to the best of your knowledge, you have authority or a legitimate basis to submit it, and any photographs, documents or other materials may lawfully be used.
You must not submit Memorial Content that is false, misleading, defamatory, unlawfully obtained, infringing, unnecessarily intrusive, or likely to expose a living individual’s personal data without an appropriate basis.
We may verify information, request documents, decline or delay publication, standardise formatting, restrict visibility, correct manifest errors, or remove material that breaches these Terms. Publication does not constitute our endorsement or independent verification.
Where administration functionality is available, we may recognise the original contributor, a verified family representative, an estate or personal representative, or another authorised administrator.
Before granting, transferring, restricting or removing administration rights, we may request identity evidence, proof of relationship or authority, official records, written consent, a court or authority document, or other reasonable evidence.
Administration does not create ownership of the deceased person’s name, identity, image, public record or family information. An administrator must act responsibly, respect legitimate family interests and promptly correct material inaccuracies.
We may suspend or revoke administration where authority is disputed, evidence is insufficient, fraud or misuse is suspected, a legal concern arises, or restriction is reasonably necessary to protect affected persons.
We do not determine inheritance, succession, estate administration, family status, religious entitlement, or legal ownership disputes.
Where competing claims concern a memorial, photograph, record, edit, removal or administrator, we may preserve the existing state, suspend editing, restrict access, request evidence, hide disputed material, place the matter on hold, or require the parties to obtain external resolution.
We may consider apparent authority, documentary evidence, urgency, risk of harm, legal obligations and fairness, but are not obliged to adjudicate the underlying dispute. We may comply with a binding court order or lawful direction.
A claimant must provide accurate information and cooperate with verification. Knowingly false claims may result in restriction, termination or referral to the appropriate authority.
Users may submit photographs, biographies, tributes, prayers, comments, reviews, communications, documents, Memorial Content and other material.
You remain responsible for User Content and warrant that you have the rights and permissions necessary to submit it. User Content must be accurate where presented as fact and must not violate law, privacy, confidentiality, intellectual-property rights or the rights of any person.
You must not submit malicious code, hidden tracking, unlawful material, impersonation content, hate content, harassment, threats, scams, deceptive solicitations or content that interferes with the dignity and purposes of the Platform.
You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, transferable to our service providers, and sublicensable licence to host, store, reproduce, format, adapt for technical display, process, transmit, display and distribute User Content solely as reasonably necessary to operate, secure, maintain, administer and improve the Platform and provide the requested services.
This licence does not transfer ownership to us. It continues for so long as the User Content remains on the Platform and for a reasonable period in backups, audit records, legal holds or archives, subject to applicable law and the Privacy Policy.
You may request removal through the applicable process. Removal may be declined, limited or delayed where content is needed to complete a transaction, preserve another user’s rights, resolve a dispute, meet a legal obligation, prevent fraud or maintain necessary records.
The Platform may present or facilitate Donation Programmes. The campaign page should identify the campaign purpose, recipient or administrator, target and other material conditions where available.
By contributing, you authorise the stated amount and acknowledge that campaign outcomes cannot be guaranteed. Donations are generally non-refundable after successful processing unless the campaign terms state otherwise, the transaction was unauthorised or erroneous, the campaign is cancelled, or a refund is required by law.
We may publish aggregate campaign totals and utilisation information. Donor identity will be displayed only in accordance with the selected preference and Privacy Policy.
We may reject, pause, investigate, suspend, modify or remove a Donation Programme where there is suspected fraud, misleading information, misuse of funds, legal or regulatory concern, a sanctions or payment issue, reputational risk, or non-cooperation by the campaign owner.
The precise operator, recipient, handling of funds, fees, receipts, tax treatment, disbursement and refund process are and must be stated before publication.
The Platform may enable users to browse, enquire about, reserve or purchase funeral-related products, memorial goods, religious products, printed materials, souvenirs and other goods or services.
The seller or Service Provider responsible for each item or service should be identified at or before checkout. Depending on the transaction, we may act as marketplace operator, facilitator, coordinator, agent or seller. Our exact role is platform as a service.
If a third party is the seller or supplier, that party is responsible for fulfilment, conformity, warranties and remedies to the extent stated in the listing and required by law. We remain responsible for obligations that apply directly to us and cannot lawfully be excluded.
Sellers and Service Providers must provide accurate listings, comply with applicable law, honour accepted orders, avoid misleading practices and cooperate with complaints, returns and investigations.
By placing an order, you confirm that the supplied information is accurate, the payment method is valid and authorised, and the transaction is genuine.
An acknowledgement of submission is not necessarily acceptance. A binding order is formed when acceptance or fulfilment confirmation is issued by us or the relevant seller or Service Provider, subject to applicable law.
We or the responsible seller may reject or cancel an order for unavailability, obvious pricing or description error, failed payment, suspected fraud, legal restriction, inability to verify information, or inability to fulfil. If payment has been received for a cancelled order, the appropriate refund will be processed subject to lawful deductions and disclosed terms.
Prices, fees, availability, dates, slots, burial plots, products and provider capacity may change. The total payable amount, including disclosed taxes, delivery, payment, service or regulatory charges, should be shown before confirmation.
Where an obvious pricing or description error occurs, we may correct it and offer you the choice to proceed on the corrected basis or cancel for a refund. Nothing in this clause permits misleading pricing or limits mandatory consumer rights.
Images may be illustrative. Material product or service characteristics, restrictions and exclusions should be stated in the relevant listing or order documentation.
Payments may be processed by third-party banks, gateways, digital-wallet operators or other authorised payment providers.
You must provide valid and authorised payment information. We may use payment status, reference numbers and limited transaction details to administer orders, refunds, reconciliation, fraud prevention and support.
We do not guarantee uninterrupted third-party payment systems and are not responsible for a provider outage beyond our reasonable control. We will, however, take reasonable steps to assist with a payment issue relating to a transaction on the Platform.
Your use of a payment service may also be subject to the provider’s terms and privacy notice.
Refund and cancellation eligibility depends on the nature and timing of the product or service, work already performed, perishable or customised characteristics, third-party commitments and applicable law.
Before purchase, the applicable cancellation rules, non-refundable components and material deadlines should be disclosed. Emergency or time-sensitive funeral services may involve costs immediately incurred after acceptance.
A refund request must be submitted through the company with the order details and supporting information. Approved refunds will normally be returned through the original payment method unless another lawful method is agreed.
Nothing in these Terms excludes statutory consumer guarantees, remedies, cooling-off rights or refund rights that apply and cannot be excluded.
The Platform, software, source code, databases, design, branding, logos, trade marks, graphics, compilations and operator-created Content are owned by or licensed to B TAG and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Platform for lawful personal or authorised business purposes connected with the services.
Except as permitted by law or with prior written consent, you must not copy, republish, sell, license, scrape, systematically extract, modify, reverse engineer, create derivative works from, frame, mirror or commercially exploit the Platform or operator-created Content.
Third-party marks and Content remain the property of their respective owners. User Content remains subject to Section 10.
The Platform may link to third-party websites, applications, resources, government bodies, payment providers or Service Providers for convenience.
We do not control or approve all third-party content and do not endorse a linked service merely by linking to it. Third-party use is subject to that party’s terms and privacy practices.
We are not responsible for a linked site’s availability, content, security or conduct, except to the extent responsibility cannot lawfully be excluded. You should assess the relevant terms before use.
You may create a fair and lawful text link to the Platform that does not damage our reputation, imply endorsement, misrepresent association, obscure the destination or present the Platform within a frame.
You must not use our marks, deep-link to restricted areas, bypass access controls, mirror Content, or link from unlawful, deceptive, defamatory, infringing or harmful content without written permission.
We may request removal or disable access to an unauthorised or harmful link and may revoke linking permission where reasonably necessary.
The Platform may display advertisements, sponsorships, partner promotions, listings and other third-party material.
Unless expressly stated, the appearance of third-party material does not constitute our endorsement, guarantee or offer. A transaction concluded directly with a third party is between you and that party.
Third parties are responsible for ensuring their information is accurate, lawful and not misleading. We may remove or restrict third-party material that breaches Platform requirements.
You must use the Platform lawfully, respectfully and only for its intended purposes. You must not:
engage in fraud, deception, impersonation or unauthorised fundraising;
harass, threaten, exploit or unlawfully discriminate against another person;
submit unlawful, defamatory, infringing, misleading, indecent or malicious content;
access another Account, system or data without authority;
introduce malware, probe security, bypass controls, disrupt availability or facilitate cyber abuse;
scrape, harvest or systematically extract data without written permission or lawful authority;
use bots or automated access in a manner that burdens, manipulates or interferes with the Platform;
reverse engineer or attempt to discover source code except where a legal right cannot be excluded;
misuse funeral, deceased-person, family, donation or payment information; or
use the Platform for unlawful commercial solicitation, spam or activities inconsistent with its purposes.
We may receive reports, review material and take proportionate action to protect users, affected families, the public, Service Providers and the Platform.
Possible action includes requesting information, correcting manifest formatting errors, adding context, reducing visibility, preserving evidence, suspending publication, removing content, restricting functions, suspending an Account, terminating access or referring a matter to an appropriate authority.
We may act without prior notice where urgent action is reasonably required for safety, security, fraud prevention, legal compliance, protection of rights, preservation of dignity, or prevention of material harm.
Where appropriate, an affected user may submit a review request through customer service. We may decline repeated, abusive or unsupported requests.
Personal data is handled in accordance with the eKubur.my Privacy Policy and applicable law. The Privacy Policy should be read together with these Terms.
Use of the Platform may involve account data, identity or authority evidence, contact details, service and transaction information, communications, technical data, User Content, Memorial Content and information about living family members or representatives.
Information about a deceased person may not be treated identically to personal data about a living individual. However, Memorial Content may contain personal data about living persons, and privacy, confidentiality, dignity and other legal interests may still apply.
Privacy requests may be submitted to customer service.
The Platform is provided on an “as available” basis. We may perform maintenance, upgrades, security work, testing and feature changes.
Availability may be affected by telecommunications, cloud, payment, cemetery, government, emergency, supplier or other dependencies beyond our reasonable control. We do not promise uninterrupted or error-free availability unless a separate written service commitment states otherwise.
We will use reasonable efforts appropriate to the circumstances to restore affected functions and communicate material disruption where practicable.
We may suspend, restrict or terminate access where we reasonably believe there is a breach of these Terms, fraud, abuse, security risk, unlawful activity, non-payment, harmful content, legal requirement, repeated complaints, or risk to users or the Platform.
Where appropriate, we may provide notice and an opportunity to respond. Immediate action may be taken where delay could increase harm or compromise an investigation.
You may request Account closure through customer service. Account closure does not automatically remove memorials, transactions, campaign records or content administered for others.
After termination, we may retain records required for legal compliance, accounting, audit, security, fraud prevention, dispute resolution, enforcement, backups or protection of rights, in accordance with the Privacy Policy and approved retention schedule.
Provisions intended by their nature to survive termination, including intellectual property, licences needed for retained records, disclaimers, liability, indemnity and dispute terms, will continue to apply.
The Platform, general information, User Content, Memorial Content, campaign information, Marketplace Services and third-party materials are provided on an “as is” and “as available” basis, subject to rights that cannot lawfully be excluded.
We do not warrant that user-submitted information is independently verified, that every provider, product, plot, appointment or campaign will remain available, or that all third-party systems will operate without interruption.
Funeral, burial, religious, administrative and educational information is general in nature unless expressly provided as a contracted professional service. Users should obtain appropriate advice from qualified religious, legal, medical, financial or other professionals where their circumstances require it.
Nothing on the Platform constitutes a guarantee of a particular funeral, burial, campaign, religious, administrative or marketplace outcome.
To the maximum extent permitted by law, B TAG and its officers, employees and affiliates will not be liable for indirect, incidental, special, punitive or consequential loss, loss of profit, loss of opportunity, loss of goodwill or loss of data arising from use of the Platform.
This limitation does not apply to liability that cannot lawfully be excluded or limited, including any applicable mandatory consumer rights. It also does not exclude liability for fraud or other liability that applicable law prohibits us from excluding.
Where liability may lawfully be limited, any monetary cap must be confirmed by external legal counsel after the operator’s role, insurance, transaction values and applicable consumer law are verified.
We are not responsible for a Service Provider’s act or omission where the provider is an independent contracting party, except to the extent we have assumed responsibility, failed to meet our own obligations, or liability cannot lawfully be excluded.
To the extent permitted by law, you agree to indemnify B TAG against third-party claims, losses, liabilities and reasonable costs arising from your material breach of these Terms, unlawful User Content, infringement of rights, fraudulent conduct, or misuse of the Platform.
This indemnity does not apply to the extent a claim results from our negligence, breach, unlawful conduct or failure to meet an obligation that cannot be excluded. We will provide reasonable notice of a claim and will not require you to settle a claim admitting liability on our behalf without consent.
These Terms are governed by and construed in accordance with the laws of Malaysia. The appropriate Malaysian courts will have jurisdiction, subject to any mandatory consumer right to bring a claim in another forum.
Before starting formal proceedings, a party should provide written notice describing the dispute and requested resolution. The parties should attempt in good faith to resolve the matter through discussion within a reasonable period.
Nothing prevents a party from seeking urgent injunctive or protective relief, reporting a matter to an authority, or using a consumer complaint mechanism available under applicable law.
We may update these Terms to reflect changes in the Platform, law, technology, security, third-party arrangements or business practices. The updated version will state its effective date.
Where a change materially affects users’ rights or obligations, we will provide appropriate notice through the Platform, email, Account notification or another reasonable channel. Where required by law, we will seek renewed agreement or consent.
Continued use after the effective date constitutes acceptance only to the extent permitted by law. Changes will not retrospectively alter a completed transaction unless lawful and agreed.
